Shashi Kant Sharma was on Thursday May 23, 2013 sworn in as CAG by President Pranab Mukherjee in the Rashtrapati Bhavan. 

 

The 61-year-old 1976 Bihar cadre IAS officer replaced Vinod Rai, who superannuated yesterday after a five-and-a-half year eventful tenure as the head of the Comptroller and Auditor General of India (CAG). 

 

"Shashi Kant Sharma will have a tenure up to September 24, 2017," an official statement said. 

 

He was holding the post of defence secretary prior to this new assignment. 

 

Sharma's appointment comes at a time when the CAG has come under sharp attack from the government and ruling party for its reports on assessment of Rs 1.76 lakh crore loss in allocation of 2G spectrum. 

 

Under Vinod Rai's tenure, the CAG was accused of going beyond its auditing ambit and indulging in analysing policy decisions. 

 

Vinod Rai, however, had hit back saying the government just wanted the CAG to be an accountant. 

 

The new CAG will have to handle the audit report on AgustaWestland chopper deal, among other reports. He was closely associated with the deal from its early days till its completion in 2010.

Sonia Gandhi through PM Manmohan Singh  has appointed Shashi Kant as CAG, because "it does not want another CAG like Vinod Rai, who questioned the government's role in several scams."

Thisappoint will increase the correction image of Sonia Gandhi led Congress led UPA Govt but CAG will lose its credibility and government after the Supreme Court observation wants some relief by this appointment. Next target may be highest Judiciary Authority.

 

A public interest litigation (PIL) has been filed in the Supreme Court challenging the appointment of new Comptroller and Auditor General and former defence secretaryShashi Kant Sharma.

Sharma handled several defense acquisitions and the government has given no reason for appointing him as CAG.

Bharatiya Janata Party leader Arun Jaitley said he was not making remark about the individual but it was an "institutional conflict of interest". Jaitley said a substantial part of budget was spent on defense procurement. "He will audit it himself. Is it appropriate?" Jaitley asked.

 

Arghya Sen Gupta explains rightly in the Hindu that even if Sashi Kant Sharma recuses himself from such audits, the manner in which his appointment has been made adversely affects the perception of impartiality that is necessary for an independent constitutional office-holder.

 

From December 2003, apart from three short stints elsewhere, Mr. Sharma was a key functionary throughout in the Ministry of Defense. His appointments in the Ministry, crucially as Director-General (Acquisitions) from August 2007 to September 2010, and Defence Secretary from July 2011 till today, lead to a fundamental conflict of interest. Not only will Mr. Sharma be a key functionary to be held accountable for defence procurements made under his watch but, specifically, his inputs regarding the contract signed by the Ministry with AgustaWestland, U.K., for the supply of 12 AW-101 VVIP helicopters will have to be closely scrutinised. The CAG is currently tasked with both these functions. Crucially, the CAG’s audit report on the helicopter contract and perceived irregularities therein are yet to be tabled in Parliament.

 

Nemo judex in causa sua, i.e. no person shall be a judge in his own cause, is a fundamental principle of administrative law that governs conflicts of interest.

"The judge Shaukat Aziz Siddiqui ordered that the interim bail is dismissed," Musharraf's defence lawyer Qamar Afzal said. The case is one of three against Mr Musharraf in the Pakistani courts. He is also accused of conspiracy to murder opposition leader Benazir Bhutto in 2007 and over the death of a Baluch rebel leader during a military operation in 206. Mr Musharraf returned to Pakistan on March 24 after four years of self-imposed exile

Legal option available before Sanjay Dutt:

 

The immediate course available for Dutt is to file a review petition in the Supreme Court within four weeks. If the review petition is dismissed or rejected by the court, a curative petition can also be filed. In a curative petition the lawyer will need to present a new fact related to the case not presented before the court earlier. The last option before Dutt will be of reaching out to the Maharashtra Governor who could remit his sentence. But that would depend on the recommendation of the State government.
