IBN reported on Jan 18: Information and Broadcasting Minister Arun Jaitley on Sunday slammed the media for invading privacy of individuals and running media trials. Art 370 and PoJ&K are the result of Lord Mountbatten’s hided enmity with Nehru due to his romance with Edwina: Mountbatten had several meetings with Maharaja Hari Singh and told the Maharaja that independence of the State was not a “feasible proposition”. However, he conveyed to the Maharaja that in view of the Muslim majority of the population of the State and its geographical conditions, accession to India would not be in the interests of the Maharaja.
Hari Singh was shocked because he had seen what Pakistan had wrought in the Punjab and thousands of Hindus and Sighs who had escaped from death had taken refuge in his State. Accession to Pakistan was the last act he was prepared to accomplish. He refused to open his mind to the Viceroy when the latter wanted to know what the Maharaja had decided about his future. He sought a meeting with the Maharaja the day he returned to the Indian capital, the Maharaja feigned illness and expressed his inability to talk to the Viceory. Moutbatten left the State high and dry.
Here it should also be noted that on the suggestion of Lord Mountbatten Kishmir issue was taken into United Nation by J L Nehru. In fact Lord Mountbatten wanted to take revenge with J L Nehuru for his unethical romantic relation with Edwina Mountbatten. Lord Mountbatten took this revenge by confounding the clear sighted Kashmir issue..
Claude Arpi, the well-known Tibet and Kashmir expert, analyses how Nehru’s obsession with the politics of his ancestral state eventually bequeathed a festering problem for the whole of India.
It is tragic that the famous ‘Nehru Papers’ are jealously locked away in the Nehru Memorial Library. They are, in fact, the property of his family!
It is unfortunate that during its six years in power, Vajpayee government, often accused of trying to rewrite history, did not take any action to rectify this anomaly.
Apart from Nehru’s official correspondence and notes, government reports such as the Henderson-Brookes Report (see earlier article, The Confiscation of History) are still classified more than 40 years after they were written. Some pretend that if published it would be too damaging for India’s security. It is just laughable!
As a result, today history lovers and serious researchers have only the 31 volumes published so far of the Selected Works of Jawaharlal Nehru (covering the period 1946 to 1955) to fall back on. This could be considered a partial declassification of the Nehru Papers, except for the fact that the editing has always been undertaken by Nehruvian historians, making at times the selection tainted. The other problem is that these volumes cover only the writings (or sayings) of Nehru; notes or letters of other officials or dignitaries which triggered Nehru’s answers are only briefly and unsatisfactorily resumed in footnotes.
With these limitations in mind, it is interesting to try to assess Nehru’s role in the Kashmir question. Fifty-seven years after Independence, it has remained an unsolved issue for the subcontinent.
Everything started in early 1946 when the Indian National Congress had to elect a new president. It was an accepted fact that the leader chosen as Congress president would become the first prime minister of independent India. Acharya Kripalani, Jawaharlal Nehru, and Sardar Patel were in the race for the Prime Minisster. The working committee of the Congress and the pravincial committees had to send their nomination for one of the three candidates.
Sardar Patel was easily the most popular leader at that time. Everyone knew his efficiency and his toughness for tackling difficult problems. Twelve out of 19 Pradesh committees nominated him. None nominated Nehru.
Gandhi always favoured Nehru because of his British education. He was a Cambridge graduate, and a barrister, is wanted to carry on the negotiations with the Britishers.’
Another point Gandhi made was that while Sardar Patel would agree to work as Nehru’s deputy, the reverse might not happen. He also felt that Nehru was better known abroad and could help India play a role in international affairs.
Eventually, in deference to Gandhi, Kripalani withdrew from the race in favor of Nehru. Patel had no choice but to follow Kriplani ‘so that Nehru could be in favor of Nehruelected unopposed.’ Dr Rajendra Prasad later stated: ‘Gandhi has once again sacrificed his trusted lieutenant for the sake of the glamorous Nehru.’
Here I want to give an humorous but tru example of our election tragedy.
Madhya Pradesh (inclusing present Chhattisgarh) had proved to be a Waterloo in the Lok Sabha elections for many stalwarts, including former president Shanker Dayal Sharma during his Congress days, Bharatiya Janata Party leader Atal Bihari Vajpayee, Bahujan Samaj Party supremo Kanshi Ram and even renowned freedom fighter Acharya J B Kripalani.
Acharya Kripalani stood as an independent from Raipur in 1967. However, he was defeated by Congress candidate Lakhanlal Gupta by a margin of more than 24,000 votes.
Renowned socialist leader Harivishnu Kamath’s third defeat came in 1967 when he was beaten by Choudhary Nitiraj Singh by a margin of just 22 votes.
Kashmiri Pundits got a Kashmiri Pundit Prime Minister:
Due to Nehru Kashmiri Pundits are in the streets of Delhi as refgee in their own country. He sank water to the art 370. The fact is that a Pandit was the prime minister made Kashmir a state different from the 500 other princely states.
Soon, the conflicting aspects in Nehru’s persona came to the fore. On one hand, he was a democrat and revolutionary; on the other, he was often carried away by his ‘Socialist’ ideals to the point of blundering with India’s destiny.
After becoming Congress president, he gave his support to his half brother Sheikh Abdullah (he called him his ‘blood brother’) who had been jailed by Maharaja Hari Singh of Kashmir. In June 1946, he decided to go to the valley to free Abdullah.
However, for Nehru, ‘Anything that happens in Kashmir has a certain importance for the rest of India, but recent events there have had an even greater importance.
Thus Kashmir became symbolic of the [princely] States in India.’ He wanted to take on ‘the autocratic and often feudal rule that prevails there.’ He did not realise that the princes’ support and collaboration would be indispensable during this all-important transition period for the nation.Though prohibited to enter the maharaja’s state, in July 1946 Nehru decided to defy the ban. Patel and other members of the working committee tried to dissuade him.
In a letter to D P Mishra, Patel explained: ‘He [Nehru] has done many things recently which have caused us great embarrassment. His actions in Kashmir … are acts of emotional insanity and it puts tremendous strain on us to set the matters right.’ However, Patel, always fair, added: ‘but in spite of all these innocent indiscretions he has unparalleled enthusiasm and a burning passion for freedom.’ Patel, thus, pointed out the two powerful (and opposing) aspects of Nehru’s personality.
A year later, hardly two weeks before Independence, Nehru still wanted to go to Srinagar. He wrote to Gandhi: ‘I shall go ahead with my plans,” As between visiting Kashmir when my people need me there and being prime minister, I prefer the former.’ At the stroke of the midnight hour on August 14, India awakened to life and freedom. Unfortunately, Maharaja
Hari Singh remembered the events of the previous year and while most princes signed the Instrument of Accession of their state to the Dominion of India, Hari Singh prevaricated. Maharaja began to think what would happen to him and his state under Nehru’s rule? He also knew that the future of his state could not lie with Jinnah and his government.
In September, he decided to offer Kashmir’s accession to India. This was refused by Nehru, who first wanted Sheikh Abdullah to be freed and installed as prime minister of the state. This was not acceptable to the maharaja.
Things came to a head at the end of October 1947 when Pak soldiers dressed as Kabailis from the North West Frontier Province entered the state, killing, looting, and raping along. On October 26, they had reached the outskirts of Srinagar. Hari Singh agreed to sign the Instrument of Accession.
On the same day a historic meeting was held in Delhi with Mountbatten, the governor general, as chairman. Army colonel Sam Manekshaw, who attended the meeting, recalled: ‘As usual Nehru talked about the United Nations, Russia, Africa, God Almighty, everybody, until Sardar Patel lost his temper. He said, ‘Jawaharlal, do you want Kashmir, or do you want to give it away?’ He [Nehru] said, ‘Of course, I want Kashmir.’ Then he [Patel] said: ‘Please give your orders.’
Thanks to Patel’s decisiveness, troops were flown to Srinagar the next morning and the airport, the only link with India, was saved. Military operations to expel the Pakistani raiders started.
Nehru’s lobby had made another blunder, by choosing Mountbatten to be the first governor general of independent India while Jinnah had kept the post for himself in Pakistan. At that time, it was probably easier for the Congress to have a foreigner as the head of the Dominion; it conveniently avoided having to choose among themselves. Mountbatten also became chairman of a newly created defence council. Nehru did not see a problem in this: Mountbatten were his best friends because of his affairs with Edwina.
British generals still serving in India reported to him. Mountbatten was not working for India’s interests, but the British crown’s. Perhaps he wanted to take revange with Nehru due to Edwina-Nehru affair.
Nehru’s sentimental attachment to the Mountbattens deeply vitiated the Kashmir issue. It was certainly the most important factor for the failure to find a solution in the first years of the conflict.
Events took a turn for the worse at the end of December 1947 when the governor general managed to convince Nehru that India had to refer the Kashmir issue to the UN instead of conducting a military counterattack in West Punjab. Patel did not agree. But he was sidetracked. On December 23, he wrote his resignation, but was prevented (by Gandhi) from pressing for it. From that day, with Patel out of Kashmir affairs, things went from bad to worse due to Gandhi’s love with Nehru.
In the first months of 1948, during the UN hearings, the British showed where their interests lay. The original Indian complaint was completely left aside and the Security Council began adopting anti-India resolutions.
Abdullah had already started his crusade for Kashmir’s independence. He remained Nehru’s friend till his scheming became too dangerous for India. In August 1953, he was finally dismissed by Karan Singh, the sadar-i-riyasat.
Two months earlier, Shyama Prasad Mookerjee, who had been arrested by Abdullah and left without medical care in Srinagar, died in mysterious circumstances. Nehru had visited the capital of Kashmir a few days earlier, but did not find the time to call on his former Cabinet colleague. He later wrote to Mookerjee’s mother: ‘Indeed, I hoped that the healthy climate of Kashmir might lead to an improvement in Shyama Babu’s health.’
In retrospect, despite Nehru’s love for great principles, his incapacity to take decisions in time, his inability to work with colleagues like Patel, and his friendship with individuals such as the Mounbattens or Abdullah, who had their own interests, blinded him so much that he did not further India’s national interests. The consequences have been tragic and the muddle created 57 years ago remains far from being sorted out.

Jawahar Lal Nehru was a Kashmiri Pandit. He loved to describe Kashmir as “a supremely beautiful woman whose beauty is almost impersonal and above desire”. So when Mountbatten told him about the infiltration and urged to remain cool, a raged Nehru roared following line.
“ As Calais was written upon the heart of your Queen Mary, so Kashmir is written upon mine.” But roaring was not enough…something had to be done. And be done immediately.
Next afternoon, V.P. Menon, Sam Monek shaw and an IAF officer were sent to Kashmir. Menon was to present to the Maharaja the Terms of Accessions and the army officers were to study military situation. While they flew off, the former Supreme Allied Commander of South East Asia, Lord Mountbatten, set in motion the preparations for an historic airlift to Kashmir. He ordered all India’s civil air transport to drop their passengers wherever they were and head to Delhi.
In Sam Monekshaw’s words, the situation of Kashmir was as follows. “Anyway, we were flown in. We went to Srinagar. We went to the palace. I have never seen such disorganisation in my life. The Maharaja was running about from one room to the other. I have never seen so much jewellery in my life — pearl necklaces, ruby things, lying in one room; packing here, there, everywhere. There was a convoy of vehicles.
The Maharaja was coming out of one room, and going into another saying, ‘Alright, if India doesn’t help, I will go and join my troops and fight (it) out.
I couldn’t restrain myself, and said, ‘That will raise their morale sir’. Eventually, I also got the military situation from everybody around us, asking what the hell was happening, and discovered that the tribesmen were about seven or nine kilometres from what was then that horrible little airfield.”
So, the Pakistani soldiers in Kabaili dress only 9 miles away, under immense pressure, the Maharajaja Signed the papers of accession. Kashmir was India’s now. And with those papers, V.P. Menon and Shaw left for Delhi 3 o’ clock in morning. The Maharaja then moved down to his winter palace in Jammu, a 17 hours’ journey. The exhausted King, before going to sleep, told his ADC, “ Wake me up only if Menon returns from Delhi, because that will mean India has decided to come to my rescue. If he does not come before dawn, shoot me in my sleep….because if he hasn’t arrived, it will mean all is lost.”
Morning at 9, a meeting presided by Mountbatten was held. In Manekshaws’ words,“At the morning meeting he ( Menon) handed over the (Accession) thing. Mountbatten turned around and said, ‘ come on Manekji (He called me Manekji instead of Manekshaw), what is the military situation?’
As usual Nehru talked about the United Nations, Russia, Africa, God almighty, everybody, until Sardar Patel lost his temper. He said, ‘Jawaharlal, do you want Kashmir, or do you want to give it away’. Nehru said,’ Of course, I want Kashmir.
Then Patelsaid ‘Please give your orders’. And before he could say anything Sardar Patel turned to Manekshaw and said, ‘You have got your orders’.”
After getting the order by Patel, on behalf of Nehru of course, Menon rushed to Jammu. The Maharaja would not die of a bullet in his brain. And then the civilian aircrafts gathered by Lord Mountbatten came into action.
Hided facts behind Art 370:
For Indira’s sake instead of India, Nehru’s last effort of his life to welcome Sheikh Abdullah in Delhi
First Prime Minister Nehru made the last effort of his life to settle the Kashmir issue in May, 1964. He invited Abdullah to come to Delhi as his personal guest. This made it clear that he wanted to placate Abdullah and made a new beginning in the spirit of forgive and forget.
Sh. Abdullah has given a graphic account of his meeting with Pt. Nehru after eleven years of estrangement in his autobiography. He claims to have suggested to Pt. Nehru to invite President Ayub of Pakistan to Delhi for direct talks on Kashmir and other related issues. According to him Pt. Nehru accepted his suggestion and requested him to visit Rawalpindi and invite.
According to Abdullah’s version Pt. Nehru was “Prepared to consider all earlier proposals as also any alternative proposals that maybe brought forward during talks to arrive at just, fair and mutually acceptable conclusions.”Sh. Abdullah received an invitation from President Ayub to visit Pakistan just at that time. It appeared to be pre-arranged and not just a coincidence. This cleared the way for his visit to Pakistan in the third week of May, 1964.
Before leaving for Rawalpindi Abdullah issued a press statement in which he gave his thinking about the possible solution of the problem. “The solution” he said, “should be such as does not create the feeling of defeat in any party, strengthening the foundations of secularism in India and satisfies the urge for freedom of the people of Kashmir”. It pointed to a compromise solution suiting his ambition about freedom for Kashmir through some kind of mutual arrangement between New Delhi and Rawalpindi. Abdullah and his entourage, which included his son Farooq Abdullah, got red carpet reception at Rawalpindi.
Abdullah arrived in Rawalpindi and had prolonged discussions with Pakistan’s President, General Ayub Khan. Abdullah was alleged to have sought Pakistan President’s support in the form of arms and ammunition for Kashmiri youth to enable them to take Kashmir away from India. After developing personal rapport with President Ayub Khan, Abdullah was about to go on an extensive tour of Pakistan occupied areas of Jammu and Kashmir. At the end of talk Ayub accepted the invitation of Pt. Nehru and June 15, 1964 was fixed as a tentative date of his visit to New Delhi.
From Rawalpindi, Abdullah went to Muzzaffarabad, the capital of the so-called “Azad Kashmir”. This Pak occupied district was of vital importance for Kashmir Valley because the roads which linked it with rail-heads of Rawalpindi and Havelian passed through it. He was therefore keen to woo its non-Kashmiri people to unite it with independent Kashmir of his dreams.However, fate willed otherwise.
While Abdullah was still in Muzzaffarabad, Pt. Nehru breathed his last at New Delhi on May 27, 1964. Pt. Nehru’s death at that juncture was a great blow to Abdullah. He was confident of mould Nehru to hammer out a solution suiting his ambition and the plans of Pakistan.
Sheikh Abdullah cut short his visit and rushed back to Delhi.As discussed earlier, special relationship between Nehru and Abdullah was a major factor in the making of the Kashmir problem.
There was much in common between Nehru and Sheikh Abdullah. Both originally belonged to the Kaul Tribe of Kashmiri Pandits, both were voluptuous and ambitious and both shared weakness for women and good things of life.
Sheikh Abdullah wanted to exploit Pt. Nehru to put through his three nation theory. Sheikh Abdullah has also betrayed his distrust for him in a very subtle way.
According to Sheikh Abdullah “Pt. Nehru’s love for Kashmir was more like love for a beautiful woman whom he wanted to possess and that he had come to regard him (Abdullah) as a Rakib or rival in love-for the possession of the beautiful valley.”
Sheikh Abdullah was released in April 1964 and called to Delhi. There he was the guest of Pt Nehru. He was sent to Pakistan on the advice of Nehru. He returned to Delhi.
Let the priests go to Mecca, we will go to UK:
As I discussed in my article of June 4, 2014, the Shastri Govt arrested Sheikh Abdullah. In the absence of Nehru at the helm in India, he found his plans going awry. Now he had to confront down to earth Indian Prime Minister the Prime Minister, Lal Bahadur Shastri.
Sheikh Abdullah now desired to go to Mecca for Haj. He was gladly allowed to do so. But instead of going straight to Mecca for performing Haj, he left for U.A.R, England and some other countries in furtive manner gaining support for the independence of Kashmir. Probably it is for such people that the famous Urdu poet, Maulana Hali has said:
“Sidharein Peer Kaaba ko Ham Inglistaan Jayengey,
Khuda Ka noor woh dekhein Ham Khuda ki shann dekhengey”
(Let the priests go to Kabba (Mecca), we will go to England. Let them see the light of God, we will see the glory and grandeur of God).
The Indian Government bore all his expenses and those of his companions. But he repaid his debt there and then. He delivered seditious speeches in the meetings which he addressed in London and other places. He addressed meetings of Mirpuris called in Birmingham and other cities in England. He praised Mirpuris for showing more life than Kashmiris.
From England he went to Paris and from there reached Mecca. After meeting Saudi leaders he left for Egypt to meet President Nasser. He solicited Nasser’s support for Kashmir’s freedom but drew blank. Later he left for Algeria where, besides Algerian leaders he met Chau-En-Lai, the Prime Minister of China. In the meeting both embraced in the presence of some Algerian leaders also. Yet it appeared that Government of India did not like their meeting. Chou assured him all support and announced it publicly.
Even that Sheikh Abdullah went to U.A.R. again and then to Mecca again in the name of performing Haj second time but actually he reached there for at-tending an International Muslim Conference. Though he was allowed for going to Pakistan for peace talk, but he went other countries for constructing a conspiracy against India through Kashmir issue. Government of India had already sent a delegate to attend that conference then what was the need of Sheikh Abdullah to attend conference keeping the Indian government in dark?.The reports of his
parleys as published in the foreign and Indian press and intelligence reports received by Government of India from its own sources created grave doubts about him. He was reported to be thinking of an Algeria like liberation movement to secure freedom for Kashmir. He was therefore ordered to return to India.
Government of India headed by Lal Bahadur Shastri aiming to crush the hidden conspiracy of Sheikh Abdullah cancelled the passport of them. On his return to India he was arrested at the Airport along with Mirza Mohammed Afzal Beg.
August 9: Shaikh Abdullah is dismissed from his post by the Sadar-i-Ryasatat the direct instance of New Delhi which has been finding his repeated demand for the promised autonomy irksome and, finally, intolerable. Abdullah’s successor Bakshi Ghulam Muhammad accuses him of conspiring with foreign powers to establish independent Kashmir. Abdullah is arrested by the Bakhshi administration subsequently.
By his decision to arrest and detain him he made it clear to all concerned that he was not prepared to treat Kashmir as anybody’s fief. This step sent right signal to Pakistan also. It made President Ayub realize that he could not expect a soft line on Kashmir from the new government of India. President Ayub had his own assessment of the new leadership at New Delhi and State of military preparedness of India.
Sheikh Abdullah’s arrest again and again due to his anti-India move
Nehru then gave orders for the arrest of Sheikh Abdullah on August 10, 1953. In a speech Nehru said that all trouble in Kashmir was due to Sheikh Abdullah’s bigotry and narrow Islamist communal outlook and it was he who was not allowing the state to settle down to peace and stability. Truly, the Sheikh always talked about the rights of the Muslims, forgetting that the Hindus also formed nearly 35 per cent of the population of the state and he never showed any consideration for them.
In May 1946 Sheikh Abdullah launched the Quit Kashmir agitation against the Maharajah Hari Singh and then also Sheikh Abdullah was arrested and sentenced to three years imprisonment but was released only sixteen months later on 29 September 1947.
The princely state of J&K had acceded to the Union of India, when its erstwhile Maharaja Hari Singh on 26th October, 1947 signed the Instrument of Accession.
Constitution of India came into force on 26th January, 1950 with Article 370 conferring a special status on J&K.
Sheikh Abdullah took oath as Prime Minister of Kashmir on March 17, 1948. On 8 August 1953 he was dismissed as Prime Minister by the then Sadr-i-Riyasat (Constitutional Head of State) Dr. Karan Singh son of the erstwhile Maharajah Hari Singh on the charge that he had lost the confidence of his cabinet.
His cabinet minister Bakshi Ghulam Mohammed was appointed as Prime Minister. Sheikh Abdullah was immediately arrested and later jailed for eleven years. Abdullah along with Mirza Afzal Beg and 22 others were accused of conspiracy against the Indian state for espousing the seditious cause of an independent Kashmir.
On 8 April 1964 the State Government dropped all charges and Sheikh Abdullah was released and returned to Srinagar where he was accorded a great welcome by the Muslims of the valley as Sher-e-Kashmir (the Lion of Kashmir). Nehru was suffering from a secret brain disease and he would die within 3 weeks. Nehru reconciled with Abdullah before his death, for his daughter Indira’s sake.

I reproduced here my article of June 4, 2014: Sheikh – Nehru dynasties gave strength to Art 370: Bakshi Ghulam Mohammed wanted to do away with Article 370 Instead of building a relationship with the masses, the successive Indian Governments focused on personalities who were interested in personal power and fiefdom. The relationship has been based on deception and duplicity.
The state leaders, irrespective of whatever party label they carried, were power brokers and practiced opportunistic secularism. Whenever they faced even a slight threat to their power, they raised the cry of Kashmiri identity.
The secularism practiced by the state leadership was fraudulent and it had always vacillated between secularism & communalism to suit the occasion in its reckless search for power. Democracy in the state was always only in form but not in substance. The leaders never failed to exploit the religious obscurantism always with an anti-India strain during elections.
When the Indian National Congress extended its organisation to J&K and established a separate Pradesh Congress Committee in 1966, Sheikh Abdullah issued a Fatwa from Hazratbal Shrine labeling Congress Party as an organisation of athiests. He declared that it would be a sin to offer funeral prayers for Muslims who were members of the Congress Party. He also launched a movement named Tarak-i-Mawalaat (boycott of Congress Muslims). As a rival strategy, Congress leaders in the state propped up Jamaat-i-Islami.
It has been badluck of this country that whenever one correct step was taken, it was subsequently followed by steps which were all wrong. In 1953, people of the state had hoped that the political uncertainty was over and that they could settle down to live a peaceful life. The inevitability of the return of Sheikh Abdullah was kept alive by the Indian authorities, which hung as the sword of Democles over each succeeding Government.
They were left with little choice other than bringing peace on the surface by constant and increasing doses of appeasement, which flowed in from the Centre at an extravagant scale. The more the people were sought to be appeased and pampered the more they were emboldened to ask for the moon.
Corruption was a necessary insrument which inevitably created pockets of scandalous riches on one side and spreading discrimination against large section on the other. Bakshi Ghulam Mohammed did try and succeeded to a great extent in making some developmental advances in the state but the sword of religious fundamentalism was always kept hanging over his head by his ambitious opponents, who outwardly called themselves leftists.
Sadiq tried and succeeded to a great extent in consolidating the gains of economic progress achieved by the people of the state during the Bakshi rule. Bakshi Ghulam Mohammed tried his best to uphold the rule of the law and wanted to do away with Article 370.
After Sadiq’s death, Mir Qasim became the Chief Minister. His regime was free for all types of people. It is said that in germany everything was prohibited unless permitted by law. In Italy, everything was permitted particularly that which was prohibited by the law.
In Qasim’s regime, the scenario of the group of European countries mentioned above was operative in its entirety, i.e. everything was permitted from smuggling, cultivation of charas, fundamentalist intrusion and above all silent squeezing of minorities. Everybody, who was somebody, usurped government land to turn into a big orchardist. Forests were destroyed by the elements beneath the political horizon.
Mir Qasim ultimately handed over the Riyasat to Sheikh Abdullah, and himself shifted to Central arena for fresh greenery and safer pastures. He became a Cabinet Minister in Indira Gandhi’s Government.
Birth of Sheikh Abdullah dynaty in J&K as Nehru Gandhi dynassty in Delhi: The Riyasat handed over to Sheikh Abdullah was, in turn, made over by the latter to his son, Farooq Abdullah. His son-in-law, G.M.Shah snatched away the same from his brother-in-law for a short span by intrigue. The son retook it with the help of Delhi durbar and faithfully paved the way for terrorist take-over. Terrorists are now planning to hand over the Kashmir to Pakistan and declare themselves as an independent new Pakistan.
Humble Kasmiris are wondering that their state had acceded to India in 1947 and for what sins are they being kicked like a football for the last 45 years. For what fault of theirs has India forsaken them and thrown them to exploiters.
Sheikh Abdullah, after a decade of self-exile and fruitless wanderings was brought back to power in Kashmir. This was done by Indira Gandhi, who had panicked after realising that crafty Zulfikar Ali Bhutto and his more intelligent daughter, Benazir had outwitted her in Shimla. In mid-seventies people were distraught by painful political uncertainties and leadership was engaged in sharp mutual hostility. On his part, the Sheikh settled down to turn his Riyasat and his Quom in the grip of r his dynasty.
Jammu-Kashmir has been the region of Durgahs and temples. Blaming the British to wedge a divide between the Muslims and Hindus historians said that after independence successive Congress Governments also followed the same policy for their political ambitions.
Lala Lajpat Rai in his book, Unhappy India, asserted: “The policy of divide and rule is the sheet anchor of all imperial governments. British rule in India has been persistently following that policy,”
In the 60 years rule Congress adopted the Nehru’s policy to divide and rule. Nehru adopted this policy from the Mountbatten.
Has Sheikh Abdullha dynasty birth right to revolt against India via Article 370?
I discussed this also in my article of May 30. Besieged by controversy right from its draft stage, Article370 has been the subject of heated debate ever since the Constitution came into full effect from 26th January 1950. While one section of the Indian polity has strongly demanded its abrogation, some others have vehemently opposed this demand; why, in 1999, Farooq Abdullah, the State’s then Chief Minister, even threatened a revolt if the Article were revoked.
Here it should be noted that his father Sheikh Abdullah had revolted again and again and for this Anti-India and Anti-Kashimiri people stand, he remained in the prison. What is harm if there will be discussion on Article 370? But Sheikh Abdullah dynasty thinks that they have copy right on the article 370 and no body has right to discuss it. This Sheikh Abdullah dynasty thinks that J & K is the property of them. Voters of J & K have punished National Conference in Lok Sabha Election 2014.
Omar Abdullha tweeted tweeted, “So the new MOS PMO says process/discussions to revoke Art 370 have started. Wow, that was a quick beginning. Not sure who is talking.”
He went on to add, “Mark my words & save this tweet – long after Modi Govt is a distant memory either J&K won’t be part of India or Art 370 will still exist.”
BP General Secretary Ram Madhav targeted Omar Abdullah on his above comment “J&K won’t b part of India? Is Omar thinking its his parental estate? 370 or no 370 J&K has been n will always b an integral part of India,”

Mysterious Death of Sunanda
Sunanda Pushkar’s Death: A Case With Long Ghost Hands: While the circumstances in which Dr Gupta has revealed this piece of information in front of CAT maybe debatable, there is a little element of surprise in the news. The reason is simple: Pushkar had given a clear warning to everyone before her death. The death of Pushkar was sudden and mysterious. When the report of her death early morning on January 17 flashed on the television channels, the couple was courting a huge controversy.
Mail Today reported: At least three people were present at different times on Wednesday Jan 15 evening with Sunanda Pushkar in room 307 of the Leela Palace. After an ugly spat with husband, junior HRD minister Shashi Tharoor in the aircraft on Wednesday Jan 15 afternoon,
Sunanda refused to accompany him to his Lodhi Estate residence on arrival in Delhi. Instead she booked herself at the Leela. This is the friend’s account: After landing at Delhi airport on a flight from Thiruvananthapuram with Shashi Tharoor, Sunanda refused to go to the Tharoors’ government bungalow in Lodhi Estate. This paper had earlier The two had been arguing in the aircraft as well at the airport.
Sunanda went straight to the Leela Palace hotel and booked herself into room 307, not suite number 345, as was earlier believed. In the evening a close friend, who is also Kashmiri and lives in south Delhi, allegedly came to assuage and calm her. They were then joined by a prominent former CEO, also a close friend, who spent a couple of hours in the room, trying to reason with her.
Soon after this, another friend of Sunanda’s came. This friend soon realised that the situation was out of control, and moved into the room.
The other two friends left after some time. In the presence of this friend, an agitated Sunanda allegedly called up Mehr Tarar, the Pakistani journalist who she had accused of having an affair with Shashi. She continued to chain-smoke through the night and was nervous and stressed.

The next day, he also booked two rooms, number 345 – the suite Sunanda was ultimately found dead in – and number 342 for his staff.
Sunanda, one friend says, then began to feel a little less agitated and at around 2:30 on Friday morning, ordered a mushroom soup for herself and a burger for her friend. Sensing that Sunanda was feeling better, the friend left for the airport around 5am. That was the last time this person saw Sunanda alive. (Source Daily Mail of Jan 22 and India Today)
According to a police source, Narayan who held from kerala told them that he had travelled with the couple to Thiruvananthapuram on January 10. There, Sunanda had been admitted to the Kerala Institute of Medical Sciences (KIMS). On January 15, the couple returned to Delhi. The couple also had an argument during Thiruvananthapuram-Delhi flight which continued even after they reach Delhi.
This open display of differences between the couple, sources said, was seen by that time I & B minister Manish Tewari, who sat across the aisle from the couple. Tewari boarded the flight at Mumbai where he had attended a function.
Mr Tharoor’s assistant, Abhinav Kumar, informed the police at around 9 pm that Mrs Tharoor had been found dead in leela hotel room no. 345 of third floor, show severe bruises. Kumar said, Tharoor believed his wife was sleeping in bed, and he inquiried from the hotel staff, since when was Sunanda sleeping. Tharoor immediately called me over phone, he added. Central Forensic Science Laboratory team reached the hotel around 10:30 PM and immediately swung into action.
Kumar told reporters at the hotel that Tharoor and Pushkar were staying in a suite since yesterday Jan 16 as some painting work was on at home.
The Minister was away throughout the day in the AICC meeting which ended at 5pm, he came back between 8:15 pm and 8:30 pm.
According to police sources, Narayan, one of the attendants, who was present in Sunanda’s suite on Friday few hours before Sunanda died had told police that the deceased had not been eating properly and would sip only coconut water and smoke cigarettes. She took recourse to Hindi songs, tweeted sad songs before death.
Narayan told Police that he went to her hotel room at 6 am, and at 7:30 am Shashi Tharoor left saying he was going to attend the AICC meet at Talkatora stadium, though the meeting was scheduled at 10 am. “At 10 am, according to Narayanan, the driver came to the hotel room with an unknown man. At that time, the CCTV on the third floor of the hotel was not working, though the CCTV was active on other floors. All these are matters for investigation”, said Dr Swamy in Aap ki Adalat.
Narayan told police that he had left the suite in the morning. He further informed that he and Bajrangi, who is also Shashi’s driver, had called out to Sunanda on Friday at around 4 pm and again at 5pm. “We called out to Madam, Since she didn’t respond, we assumed she was asleep. Then we called sahab (Shashi Tharoor) and told him that she wasn’t opening the door,” Narayan told police.
The minister returned from the AICC session at around 8 pm, asked the hotel staff to open the bedroom with a master key. When he entered the room, he found her dead and called a doctor
According to the police officer, Narayan told them that he had travelled with the couple to Thiruvananthapuram on January 10. Sunanda had been admitted to the Kerala Institute of Medical Sciences (KIMS). On January 15, the couple returned to Delhi. The officer said Narayan claimed Sunanda did not return home to Lodhi Estate with Tharoor and checked into the hotel the same Jan 15.
The next day (Jan 16), Tharoor came to the hotel and checked into another room. The couple later moved into the suite. Narayan said he was in the anteroom when he heard the couple arguing on Thursday night, the officer said, adding that all these statements were still being verified with independent sources including hotel records:
According to Sunanda Pushkar’s close friend Nalini Singh, a journalist, and domestic help Narayan Singh, Tharoor had extra marital relations with several other women. When Pushkar came to know about it, differences between the husband-wife started brewing and their relations got strained. She was extremely depressed and angry.
Nalini told investigators that Pushkar wanted her help in retrieving some BBM messages exchanged between Tharoor and Tarar. According to the statements made before investigators, Tharoor met Tarar in Dubai in June 2013. They stayed together at a hotel there for three days. Sunanda Pushkar’s friends have given the police evidence to establish their claims.
According to a statement by senior journalist Nalini Singh, recorded before a subdivisional magistrate (SDM), the couple had been squabbling for a week before Pushkar’s death and had also got into scuffles over Tharoor’s alleged affair with Pakistani journalist Mehr Tarar.

A senior doctor at AIIMS said Sunanda Pushkar could have died between 1 pm and 7 pm on Friday. The three member team that conducted the autopsy collected tissue samples from her body and sent it for a toxicological analysis and other tests to get more clarity on the cause of death.
* Days after her death, Sudhir Kumar Gupta, head of forensic medicine at the All India Institute of Medical Sciences (AIIMS), who was part of the three member team that conducted the autopsy, said, “After post-mortem examination, we found it was a case of sudden unnatural death.”
Revealing that Sunanda’s body bore some marks of external injuries and bruises, Dr Sudhir Gupta, head of the forensic sciences department, All-India Institute of Medical Sciences (AIIMS) said that “the injuries might not be the cause of death”.

In an interview to a TV news channel, Headlines Today, Subramanian Swamy maintained that “credible sources” told him that there were bruises on the body “from belly up”, and “it seemed that someone had held her nostrils so that her mouth was open”. He added there was evidence that her blood stream had traces of lethal poison of Russian origin. He claimed that all the photographs of Sunanda’s body, which were taken by the police, were destroyed.
Doctors have preserved viscera, blood samples and portions of certain vital organs, including the heart, for a histopathology. The final report will be handed over to the police in the next two days.
“The viscera samples include portions of her heart, lungs, liver, kidney, hair, and portions of the skin that bore injury marks,” AIIMS spokesperson Amit Gupta said.
Pushkar’s caretaker Narayan also claimed before the SDM that the couple had been quarrelling for days. “I had gone along with the couple to Thiruvananthapuram where they got into a heated argument over Tarar. We later returned on 15 January afternoon but on the way back they again started fighting,” Narayan told the SDM. He also said on January 16 night the couple had an ugly spat over Tharoor’s alleged relationship with Tarar. The quarrel continued till 4.30 am on Friday.
The caretaker also said that the injury marks on Pushkar’s body could be due to a physical struggle.
India legal rightly raised questions:
* Why was the probe handed over to the local police, and not the Crime Branch?
* Why was Tharoor’s mobile taken away, but was hurriedly returned even before the case was closed?
* If she had taken an overdose of drugs, why did the police not find any medicine bottle or foil of tablets in the room?
* How come in a five star hotel room there was nothing that the police found, not even a bottle of water?
*What did the close circuit television system of the hotel show? Was it in working condition?

Why was Sunanda Pushkar cremated in hurry within 24 hours, though the Delhi-police still awaits the visceral report? Subramanian Swamy also doubt on this?
Subramanian Swamy said that it was rare in criminal jurisprudence that the body of a person, who died in ‘mysterious’ circumstances, was cremated within 24 hours. He wanted the doctors who had performed the post mortem to be made witnesses by the police.
Swamy had then questioned Tharoor’s nervousness regarding his wife’s death, even as the Delhi Police investigation was in progress.
According to the Lt. Governor of Delhi’s rules, an autopsy has to be conducted by a three-member expert group each belonging to three different institutions to avoid any conflict of interest, in cases like these. But in this case, the autopsy panel was headed by Sudhir Kumar Gupta, professor and head of department forensic medicine, and included Adarsh Kumar, assistant professor, and Shashank Pooniya, senior resident; all from AIIMS.
There were severe bruises on parts of her body and face, pictures of which were taken immediately after she was found dead. Since there were no eyewitnesses, and none have come forward until now, police investigations revolved around circumstantial evidence, forensics, and medical reports. The most crucial among them was the post-mortem report by AIIMS, the state-funded hospital in New Delhi.
The manner of Pushkar’s autopsy has been in total contravention of the ascribed norms. But the city police is always known to be rather comfortable in constructing a tailor made report from panel members from one hospital rather than take a complex one and raise fresh issues for the case to get prolonged.
It must be noted also that the cases where post-mortems were conducted by members of different institutions had changed the whole case and the lead itself. For example, when autopsy was conducted on Anju Illyasi, wife of TV journalist Suhaib Illyasi, in 2000, the panel members came to the conclusion that the knife wounds were not inflicted by the deceased. This fact at once shifted the track of investigations.
There is enough circumstantial evidence to negate the possibility that Pushkar’s death was not due to suicide or even a drug overdose. Hours before her death she had tweeted that she had several health issues and that she would die with joy and smile on her face. Apart from Kanwal, she had also called journalists Barkha Dutt of NDTV and Nalini Singh. Even if she wanted to commit suicide, why would she do so without talking to one or all of them?

Dr Subramanian Swamy has termed Sunanda Pushkar’s death as murder since the event took place and the doctors at AIIMS declared it as unnatural death. Dr Swamy had alleged that Pushkar was killed using some Russian poison. The scars found on Pushkar’s body in the post-mortem report further helped his charges. Dr Swamy alleged that in order to prevent Sunanda Pushkar from exposing the underworld links and illegal money laundering in the high-profile cricket league Indian Premier League (IPL), she was put to rest by the Dubai Mafia.
Police investigators had said it could be a case of drug overdose or overdose of sleeping pills but added that things would be clear only after the detailed autopsy report was read.
They recovered two strips of alprax drug from her hotel room.
“The huge quantity of consumption of such drug may affect functioning of brain and leads to a comatose situation,” said a police officer.
A police source said she often took sleeping pills. The cops claimed to have found Alprax tablets from her room number 345. Alprax is a prescription medicine given for nervous disorders.

According to leading independent forensic expert, Dr K.L. The experts also say that it needs to ascertained as to whether Sunanda was taking the medicine on the doctors’ prescription of on her own. They say that histopathologic tests must be conducted to ascertain the exact cause of her death. The police had earlier found some used strips of Alprax inside the hotel room where Sunanda Pushkar had been found dead.
Doctors say in most cases patients with such overdose survive if rushed to hospital in time. Unfortunately in Sunandaâ€™s case, sources say rigor mortis had set in the body by the time it was taken to the hospital.
Earlier, in their autopsy report, AIIMS forensic experts had said that Sunanda died of poisoning, but had shied away from clarifying what kind of poisoning. They also said that her body had injury marks but, again, had not specified what kind of injury marks were seen on her body during the autopsy. Experts say that only the viscera examination might not be enough to ascertain how she died of poisoning. They say that an incomplete autopsy will be futile and unless histopathology is done it will be difficult to find out how she died. (10) IPL Commissioner Lalit Modi revealed that Tharoor’s friend (later his wife) Sunanda Pushkar had equity stakes in Rendezvous Sports World (RSW), heading the consortium that owns the Kochi team. It was later disclosed that Pushkar got sweat equity of the value of Rs 70 crore. Shashi Tharoor maintained that the amount had nothing to do with his active campaigning and mentoring for the Kochi team. This was less convincing as he had specifically mentioned that he had no specific gains from RSW winning Kochi Franchisee. The Prime minister Manmohan Singh later demanded his resignation.

Sunanda Tharoor had reportedly contacted the hotel staff at about 3.30 pm on Friday to order lunch.
At about 8 pm, Mr Tharoor had tweeted that he would not attend the Jaipur Literature Festival that began on Friday because his wife was unwell.
Mr Tharoor returned at about 8:30 pm after spending the day at a mega-conclave organised by his Congress Party, the Congress. When his wife did not open the door to the bedroom of her suite no 345, he asked the hotel staff to help him enter the room, only to find her lying dead on the bed.

In a significant development, the probe into the mysterious death of Sunanda Pushkar, wife of Union Minister Shashi Tharoor, was on Thursday transfered to the elite Crime Branch of Delhi Police, reflecting the complexities in the high-profile case.

The probe has been handed over to Crime Branch two days after a sub-divisional magistrate directed the police to investigate the murder or suicide angles in the case.
“We will proceed in the case as per law,” said Special Commissioner (Crime) Dharmendra Kumar.
Sources said the case has been transferred considering its ‘sensitive nature’ and ‘complexities’ involved.
Asked whether Crime Branch will question Tharoor and 11 other people who had already given their statement to the SDM, Kumar said a decision in this regard will be taken after examining the case details.
The case was earlier handled by the South district police. It had questioned a number of staff of Leela Palace hotel in Chanakyapuri where Sunanda was found dead.
On Tuesday, sub-divisional magistrate Alok Sharma in his report had concluded ‘poisoning’ as the reason for Sunanda’s death and asked the police to investigate the case ‘thoroughly’.
52-year-old Sunanda was found dead in a 5-star hotel in South Delhi on Friday night, a day after her twitter spat with Pakistani journalist Mehr Tarar over an alleged affair with Tharoor.
“I have ordered the Delhi Police to further probe the mysterious death of Sunanda Pushkar as she is found to have died due to poisoning,” Alok Sharma, the SDM of Vasant Vihar, told Mail Today.
The police have also seized all mails exchanged between Tharoor and Pakistani journalist Mehr Tarar.

ISources said a suicide note has not been found.
In a report to the police, SDM, who has recorded the statements of Sunanda’s brother, son, Tharoor and his staff, said that no family member suspected any foul play in the death.
The couple’s driver, Bajrang, told the police that Tharoor had an argument with Sunanda on Thursday evening. He told the police that the couple also had arguments during their recent stay in Thiruvananthapuram.
A crime branch team also visited the luxury hotel in connection with the case and questioned hotel staff. The police is also examining the telephone call details of the couple and the hotel’s CCTV camera footage.

A family friend of the Lalls, who was at the Apollo hospital at the time, recalled: “She then told Sabrina and her parents to forget about what had happened. She said, Jessica won’t come back, and advised them to forget about everything. ‘You don’t know the people you are up against. They are rich and dangerous. You will not achieve anything.’ I was shocked.”

Her personal assets, duly listed on the PMO website, include 12 apartments in Dubai, one in Canada, real estate in Jammu, jewellery and designer watches worth Rs 7 crore and an equal sum in bank deposits. At last count, she was worth Rs 113 crore apart from an unevaluated sword, an artefact all the way from Mughal emperor Humayun’s reign.”

January 17, 2014: Sunanda Pushkar, wife of former Union Minister Shashi Tharoor, found dead under mysterious circumstances in suite no 345 of Hotel Leela Palace in New Delhi. While police suspected she might have committed suicide, the possibility of medicine overdose was not ruled out since Pushkar was undergoing medical treatment. Inquest proceedings under Section 174 CrPC were initiated in the Sunanda case according to which a sub-divisional magistrate inquires into the death of a woman if she dies within seven years of her marriage.
January 19: The doctors who conducted postmortem on Sunanda Pushkar Tharoor at AIIMS said it appeared to be a case of “sudden, unnatural death”, and that she had “certain injuries on the body”. The autopsy report of Sunanda was learnt to have said that she died due to “poisoning” and neither confirmed nor ruled out suicide. The autopsy board included two other doctors, additional professor of forensic medicine Dr Adarsh Kumar and a senior resident in the department, Dr Shashank Puniya. The autopsy report had mentioned more than a dozen injury marks on Sunanda’s hands and an abrasion on her cheek which suggests a “use of blunt force”, besides a “deep teeth bite” on the edge of her left palm. Although “nominal traces” of the anti-anxiety drug Alprazolam were found, there were “no findings suggestive of drug overdose”.
January 19: Kerala Institute of Medical Sciences (KIMS), where Sunanda Tharoor had undergone treatment from January 12 to 14, said that she was not diagnosed with any life-threatening disease. KIMS Hospital director and cardiologist Dr G Vijayaraghavan said Pushkar was not diagnosed with any serious medical condition that could cause immediate death.
January 21: The subdivisional magistrate (SDM) who was heading the inquest said that Sunanda died of poisoning. In his report, the SDM has said that Sunanda has died of poisoning and has asked police to probe the cause of poisoning. Alok Sharma, the SDM has also asked the police to specifically probe the murder/suicide angle. The SDM, in his report, had said Sunanda could have died in “just three ways, homicidal, suicidal and accidental” and police should investigate further to ascertain the reason of her death. detailed report on the specific allegations levelled by a doctor, who headed the panel that conducted the post-mortem on Sunanda Pushkar.
July 02: Sunanda Pushkar’s husband and former Union minister Shashi Tharoor demanded a “clear and definitive conclusion” to the case. In a statement on Facebook, the Congress leader asserted that he had been, since the beginning, demanding thorough, rapid and transparent investigation into the case, adding that he had cooperated with the authorities fully.
July 02: With a senior AIIMS forensic doctor reportedly alleging that he was pressurised to manipulate the autopsy report of Sunanda Pushkar,Delhi Police said it will “examine” him and former Union Minister Shashi Tharoor if needed.
