Analysis: Governor’s Nomination Power and Its Impact on Legislative Council Composition

The framers of the Indian Constitution envisioned the governor’s nomination as a means to bring distinguished individuals from fields such as literature, science, art, cooperative movements and social service into the law‑making process. Article 171(5) explicitly limits nominations to those with proven expertise. In practice, however, successive governments in Bihar have increasingly used the provision to place party functionaries, raising questions about the erosion of the original intent. The current roster includes ministers, former central ministers, and party workers, with only a handful—such as scholar Ramvachan Rai and medical expert Dr. Rajyavardhan Azad—meeting the constitutional criteria.
