Tenant’s Request for Extension Doesn’t Stop Rent Increase, Court Clarifies

In the matter before the bench, tenants argued that their request to extend the move‑out period should shield them from the agreed 20% rent hike. The court rejected that argument, stating that the lease’s escalation provision activates automatically as long as the tenant remains in possession. The decision applies even when the lease deed is not registered, as long as both parties have acknowledged the escalation clause. Legal analysts say the verdict will bring greater certainty to lease disputes, compelling tenants to either vacate promptly or honour the higher rent until they do so.
