Division bench rejects FCI appeal, stresses dignity of pregnant workers

A two‑judge division bench of the Chhattisgarh High Court dismissed the Food Corporation of India’s petition to overturn the earlier order that protected a pregnant employee’s maternity benefits. The bench, headed by Chief Justice Ramesh Sinha and Justice Ravindra Kumar Agrawal, reiterated that maternity benefits are a statutory right anchored in the health and dignity of women workers.

The court highlighted that referencing a low leave balance or any procedural technicality to deprive a woman of paid maternity leave is untenable. The judgment confirmed the single‑bench’s directive to provide 90 days of paid leave and to refund the deducted ₹80,254.

Legal experts view the decision as a strong affirmation of gender‑sensitive employment law in India. It sends a clear message to all employers that maternity entitlements cannot be diluted through administrative loopholes.

FCI is now required to comply with the order, return the salary deduction, and ensure that the employee receives her full maternity benefits without further obstruction.
