Bilaspur. The amount of General Provident Fund (GPF) received after retiring is the basis of further life for any employee. In such a situation, the High Court has given an important verdict on the petition filed, giving the order of recovery from GPF. The bench said that the amount cannot be recovered from GPF after six months of retirement. Advocate Abhishek Pandey said that Hridaynarayan Shukla, a resident of Gorela, retired from the post of Supervisor (Male) in the Health Department on 30 June 2020. 9 months later, the Accountant General Office issued the recovery order stating the withdrawal of more than the GPF amount, stating the negative balance in their GPF account.
Challenging the recovery order, Hridaynarayan Shukla filed a petition before the High Court through advocate Abhishek Pandey and Swati Saraf.
Advocates, citing Chhattisgarh General Future Nid Rules 1955 and Chhattisgarh Civil Services (Pension) Rules 1976, said that the recovery of negative balance from GPF account can be done before retirement or after retirement only within a period of only six months. . If there is a period of more than this, no recovery of G. can be done.
Nine months after the petitioner retired in the case, the Recovery Order was issued by the Accountant General Office stating the negative balance in the GPF account, which is a violation of the rules. Accepting the petition, the High Court, after canceling the recovery order issued against the petitioner, was directed to the Accountant General Office to immediately pay the entire outstanding GPF amount of the petitioner.
